Terms & Conditions

Welcome to the Coldwell Banker Custom Store, operated by Award Maven (“Award Maven,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to—and purchase of—custom recognition products (“Products”) through awardmaven.com (the “Site”). By visiting or ordering from the Site, you accept and agree to be bound by these Terms and any policies referenced herein (Return & Replacement Promise, Privacy Policy, etc.). If you do not agree, please do not use the Site.
1. Definitions
“Customer,” “you,” “your” – Any Coldwell Banker affiliate, employee, franchise, or authorized agent who places an order.
“Products” – Custom awards, plaques, gifts, and related items sold on the Site.
“Order” – A confirmed request for Products submitted via the Site or approved purchase order.
“Final Proof” – The digital artwork file approved by you prior to production.
2. Eligibility & Account Security
You must:
Be at least 18 years old; and
Have authority to bind your brokerage, branch, or corporate entity to these Terms.
You’re responsible for all activity under your login credentials. Notify us immediately at [email protected] if you suspect unauthorized use.
3. Ordering Process
Configure your Product (style, quantity, engraving).
Upload logos or engraving text.
Review & Approve a Final Proof emailed within 24 hours (weekdays).
Pay via credit card or approved Coldwell Banker purchase order.
Production begins only after payment (or PO) and written proof approval.
4. Pricing & Payment
Prices are in U.S. dollars and exclude shipping, taxes, and duties unless stated otherwise. We reserve the right to correct pricing errors and will notify you for approval before processing an adjusted charge.
Accepted payment methods: Visa®, MasterCard®, American Express®, Discover®, ACH, or pre‑approved corporate PO.
5. Production Lead Times
Standard lead time is 10 business days from proof approval. Rush services may be available; additional fees apply. Production timelines exclude carrier transit time.
6. Shipping, Title & Risk of Loss
We ship via UPS, FedEx, or USPS, FOB Origin (Phoenix, AZ). Title and risk of loss transfer to you upon carrier pickup. Provide accurate addresses and receiving contacts to avoid delays or re‑delivery charges.
7. Returns & Replacements
Because each Product is personalized, all sales are final except in cases of:
Manufacturing defect
Engraving error versus Final Proof
Carrier damage
File a claim within 3 business days of delivery per our Return & Replacement Promise. Approved claims will be repaired, remade, or refunded at our discretion.
8. Intellectual Property
All Coldwell Banker® marks are used under license. You warrant that any artwork, trademarks, or text you supply do not infringe third‑party rights. By uploading materials, you grant Award Maven a non‑exclusive, royalty‑free license to reproduce such materials solely to fulfill your Order.
9. Acceptable Use of the Site
You agree not to:
Violate any applicable law or Coldwell Banker brand guidelines.
Upload malicious code, reverse‑engineer, or interfere with Site functionality.
Misrepresent affiliation or impersonate another person.
We may suspend or terminate access for violations without liability.
10. Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT WILL AWARD MAVEN, COLDWELL BANKER LLC, OR THEIR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE ORDER AT ISSUE.
12. Indemnification
You agree to defend, indemnify, and hold harmless Award Maven, Coldwell Banker, and their officers, employees, and agents from any claims or damages arising out of (a) your breach of these Terms; (b) infringement claims related to artwork you supply; or (c) misuse of the Site.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict‑of‑law provisions. Any dispute shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. The “Effective date” will change when revisions are posted. Continued use of the Site constitutes acceptance of the updated Terms.
15. Severability
If any provision is held unenforceable, the remainder remains in full force, and the unenforceable portion shall be interpreted to best reflect the parties’ intent.
